Certificate Attestation

Educational Certificates like 10th Certificate, 12th Certificate, Degree Certificate and Diploma Certificate and non educational Certificates like Birth Certificate, Marriage Certificate, Police Clearance Certificate attestation require on original when a person is going abroad for study or job purpose. Apart from the above mentioned Certificates there are many more documents which needs to be attested and it depends on the destination country’s rules and regulations. Also the requirements of the different documents depends on the purpose of visit of the country. In India there are various Government Authority appointed by Ministry of External Affairs (MEA) for attestation. The Attestation authorities are General Administrative Department (GAD), Regional Attestation Center (RAC), Higher Education Department, Home Department, Sub Divisional Magistrate (SDM) etc.

Certificate Apostille

The Apostille is a French word which meaning is Certification. More elaborately the Apostille could be defined as “The Hague Convention abolishing the requirement for legalization of Public Documents, the Apostille convention, or the Apostille treaty is an international treaty drafted by the Hague Conference on Private International Law. It specifies the modalities through which a document issued in one of the signatory countries can be certified for legal purposes in all the other signatory states. Such a certification is called an Apostille. It is an international certification comparable to a notarization in domestic law. In India the Apostille authority is the Ministry of External Affairs (MEA). As per Apostille process in India firstly the document or certificate needs to be attested or authenticated by the competent authority, other than the issuing authority of that particular certificate, designated by the Ministry of External Affairs (MEA) in various states. Apostille is a sticker containing the details of the document like name of the candidate, signing authority etc. 

Embassy Attestation

In India there are around two hundred and twenty eight countries’ Embassies are in existence. Among then around one hundred and three countries are the member of Hague Convention and rest are non member. In case of attestation of educational certificate and non educational certificate or even commercial document the embassy attestation or legalization is mandatory if the destination country is the non member of Hague Convention. If the destination country is the member of Hague Convention then there is no requirement of Embassy or Consulate legalization and for that the Apostille from Ministry of External Affairs (MEA) is the final attestation process. For Embassy or Consulate attestation of any document they strongly follow the attestation of Ministry of External Affairs (MEA), India. Unless until the MEA attestation is void on the document then it could not be attested by the Embassy. Some Country's Embassy is not present physically in India but they have given the power to other Embassy which is present in India to complete the attestation process on their behalf.

Commercial Document Legalization

When some India based company wishes to establish their branch in another country or wishes to tie-ups with another company in abroad then the Indian company’s certain documents needs to be attested. Also even some company wish to export some product from India then also some document needs to be attested. Normally the documents which are used for commercial purpose like exporting, shipping, opening branch in abroad are called the commercial document. As per Indian Chambers of Commerce and Ministry of External Affairs policy every commercial document firstly will be attested from Chambers of Commerce which to be used in abroad. The Chambers of Commerce attestation can be done from the concerned Chambers of Commerce in where the company is a member or can be done anywhere in India upon a payment of a particular fees. Once the document has been attested by the Chambers of Commerce then it will be attested or Apostilled by Ministry of External Affairs. Some country mandatorily requires the Embassy Legalization on the Commercial document even they are the member of Hague Convention.

Why Certificate Apostille is required?

When a person is going abroad for study, job,  immigration purpose or some company wishes to setup their branched in abroad or wishes to export their products to abroad, then their certain documents needs to be attested from the concerned authority in India to validate the authenticity of the documents.   The attestation authority and attestation process depends on the type of documents as generally documents are divided into three types like Educational documents, Non educational documents and Commercial documents.

In India there are three steps attestation process is practiced on a same document when the destination country is a Non Hague Conventional Country (Non-HCC) otherwise the attestation process could be completed in two steps for Hague Conventional Country (HCC). If the document is Commercial then firstly it will be attested by the Chambers of Commerce then it will be attested by Ministry of External Affairs (MEA) and finally it will be legalized by the destination country’s Embassy or Consulate present in India. If the destination country is the Member of Hague Convention then the Certificate will be Apostilled by Ministry of External Affairs (MEA) and there is no further requirement of the Embassy attestation. But somehow, some country further requires the Embassy Legalization in spite of the member of Hague Convention.  

If the document is Educational Certificate then firstly it will be attested or authenticated by the regional attestation center (RAC), or General Administrative Department (GAD) or Higher Education Department or Home Department etc then it will be attested by the Ministry of External Affairs (MEA) and finally it will be attested by the destination country’s Embassy present in India. If the destination country is the Member of Hague Convention then the Certificate will be Apostilled by Ministry of External Affairs (MEA) and there is no further requirement of the Embassy attestation.
